Welcome to D Luxe Destinations! These terms and conditions serve as a legally binding agreement between you, whether personally or on behalf of an entity (you) and D Luxe Destinations, a luxury travel company that offers exclusive vacations for individuals and groups. By booking a trip with us, you agree to be bound by these terms and conditions. Please read them carefully before making a booking. Pricing

All prices quoted by D Luxe Destinations are in the currency specified on the invoice and are subject to change without notice until the booking is confirmed with a non-refundable deposit of 20% of the total cost.

Payment Schedule

A non-refundable deposit of 20% of the total cost is required to confirm a booking with D Luxe Destinations. The remaining balance is due 60 days prior to the start of the trip. Bookings made within 60 days of the start of the trip must be paid in full at the time of booking. If the final payment is not received by the due date, D Luxe Destinations reserves the right to cancel the booking and retain the deposit.

Payment Methods

D Luxe Destinations accepts payment by credit card, wire transfer, or personal check. All payments made by credit card are subject to a processing fee of 3% of the total cost. Payments made by wire transfer must include any bank fees incurred. Personal checks must be drawn on a US bank and received by D Luxe Destinations at least 60 days prior to the start of the trip.

Price Changes

D Luxe Destinations reserves the right to change the prices at any time, and prices listed on the website or in promotional materials are not guaranteed until a booking is confirmed and payment is made. In addition to the trip price, clients are responsible for 

any additional costs associated with the trip, such as passport and visa fees, airfare, and any optional activities or services. D Luxe Destinations reserves the right to change the price of any time of trip due to unforeseen circumstances, such as changes in exchange rates, government-imposed taxes or fees, or other circumstances beyond our control. In such cases, D Luxe Destinations will provide notice of the change as soon as possible and will make every effort to keep any price increases to a minimum. 

Payment Plans

D Luxe Destinations offers payment plans for certain trips. A non-refundable deposit of 20% of the total cost is required to confirm a booking. The remaining balance is payable in installments, with the final payment due 60 days prior to the start of the trip. The payment schedule will be outlined in the invoice. If a payment is not received by the due date, D Luxe Destinations reserves the right to cancel the booking and retain the deposit. If the final payment is not received by the due date, D Luxe Destinations may also cancel the booking and retain any payments made up to that point. D Luxe Destinations reserves the right to modify the payment plan at any time due to unforeseen circumstances, such as changes in exchange rates, government-imposed taxes or fees, or other circumstances beyond our control. In such cases, D Luxe Destinations will provide notice of the change as soon as possible and will make every effort to keep any changes to a minimum.

Booking Policy

All bookings made through D Luxe Destinations must be confirmed with a non-refundable deposit of 20% of the total cost or $150.00. The remaining balance is due 60 days prior to the start of the trip. Bookings made within 60 days of the start of the trip must be paid in full at the time of booking. Trip deposits are non-refundable and non-transferable, trip deposits are only transferable if it becomes an D Luxe Destination Travel Credit.  All bookings are subject to availability.

Cancellation Policy

Refunds and Cancellations

All cancellations must be made in writing and received by D Luxe Destinations. 

All cancellations made more than 60 days prior to the start of the trip will result in the forfeiture of the deposit. Cancellations made within 60 days of the start of the trip will result in a 100% cancellation fee. The trip deposit and all taxes and fees charged to each trip payment are non-refundable and non-transferrable. D Luxe Destinations is not responsible for any additional expenses incurred as a result of a cancellation, such as non-refundable flights or other travel arrangements. Your trip confirmation form will be verified by our company after you submit your deposit. If deemed ineligible or an error occurs, we will contact you and you will only then be entitled to a deposit refund. No refunds will be given for any unused services, including accommodations, meals, or activities.  If you’ve failed to communicate in regard to a refund request and missed payment deadline(s) without written communication for an extensive period of time. You will be removed from the trip and won’t be eligible to receive a refund or D Luxe Destination Credit. Refunds may take up to 30 days to process and may be issued separately. For expedited refunds processing, refunds may be issued to you via Zelle or another mobile payment service provider, which can take up to 14  business days and may be issued separately.

Cancellations by D Luxe Destinations or Host Country

D Luxe Destinations reserves the right to cancel a trip for any reason, such as safety concerns, political instability, lack of capacity or natural disasters. In such cases, D Luxe Destinations will make every effort to provide alternative trip dates or destinations. If a trip is canceled by D Luxe Destinations, clients will receive a full refund not including taxes and fees.  The initial deposit will be transferred as a credit to be used for another D Luxe Destination future trip. However, depending on the third-party vendor’s refund policies, terms & conditions, a partial refund may also be received, excluding the D Luxe Destination credit and  taxes and fees.  D Luxe Destinations is not responsible for any additional expenses or monetary loss incurred as a result of a cancellation, such as non-refundable flights or other travel arrangements 

Changes to Itinerary or Trip

D Luxe Destinations reserves the right to make changes to the itinerary, accommodations, activities, or other aspects of the trip at any time for any reason, including but not limited to safety concerns due to unforeseen circumstances, such as weather, transportation, political unrest, or other circumstances beyond our control. In such cases, D Luxe Destinations will make every effort to provide a comparable alternative. 

Accommodations

D Luxe Destinations will offer 4 and 5 star accommodations which will be based on double occupancy. Single occupancy may be available for an additional fee, as specified in the itinerary. Room assignments are at the discretion of the hotel or resort and are subject to availability.  Additionally, you will only be allowed into the property or your assigned room after check-in time and in most cases, when a D Luxe Destinations host is present.

Room Occupancy

Room occupancy is based on double occupancy unless otherwise specified in the itinerary. Triple or quad occupancy may be available for an additional fee and is subject to availability. D Luxe Destinations cannot guarantee that additional bedding, such as rollaway beds or cots, will be available for triple or quad occupancy rooms. You understand that a double occupancy setting may either offer two separate beds, or one king-size for you and another individual. D Luxe Destinations  is not liable for any disputes between you and other individuals throughout the trip, including with property staff.

Inclusions and Exclusions

D Luxe Destinations provides detailed information on what is included and excluded in each trip itinerary. Inclusions may vary by trip and are tailored to its respective country , but typically include accommodations, transportation, meals, and activities as outlined in the itinerary. Inclusions are always subject to change depending on third-party vendor(s), proprietor, or our company. Exclusions may include airfare, travel insurance, and any personal expenses such as souvenirs, gratuity or additional meals and activities not included in the itinerary.

Travel Credit and Referral Program

D Luxe Destinations may offer travel credits or referral incentives for certain trips. Travel credit is issued when a trip has been canceled by you, or D Luxe Destinations  due to trip postponement, unmet minimum trip capacity, and any unforeseen circumstances that interfere with the trip. Initial trip deposit  will transfer as a D Luxe Destination Credit in these cases and is non-refundable, any taxes and fees charged are non-transferable, unless stated otherwise. Travel credits may be applied towards a future trip with D Luxe Destinations and must be used within one year of issue. 

The Referral Program is available to all D Luxe Destinations Members. Referral incentives may be provided to individuals who refer new clients to D Luxe Destinations, as specified in the referral program terms and conditions.  Refer a friend, family member, or companion to join a D Luxe Destination group trip, and earn a $50 referral credit  per referral. You can refer an individual to a current group trip or  any other available trips that are available for reservation.  The Referral credit will only be given if the referred  person has mentioned your fist and last name in the referral section at the time of deposit  and has been verified for approval.  An email will be sent regarding credit amount and will automatically be applied toward any group trip payment, or future trip.  All referral credits expire within 15 months of the first referral request.  The referral credit is non-transferable, non-exchangeable, and non-refundable. 

Health and Safety

D Luxe Destinations strongly recommends that clients obtain comprehensive travel insurance, to protect against unforeseen circumstances such as trip cancellation, medical emergencies or coverage, and lost luggage, before embarking on any trip. Clients are responsible for ensuring that they are in good health and able to participate in all activities outlined in the itinerary. D Luxe Destinations reserves the right to refuse service to clients who are deemed to be unfit for travel. 

Liability

D Luxe Destinations is not liable for any loss, damage, injury, or death resulting from any act or omission of any supplier, including but not limited to airlines, hotels, transportation providers, or tour operators. D Luxe Destinations is not liable for any loss, damage, injury, or death resulting from any act or omission of the client, including but not limited to failure to comply with any laws or regulations, or failure to follow instructions from D Luxe Destinations or its suppliers.

Injuries / Incidents

D Luxe Destinations is not liable for any injuries, losses, or damages sustained during the trip, including but not limited to injuries or damages resulting from transportation, activities, or accommodations. D Luxe Destinations is not responsible for any medical expenses incurred during the trip. D Luxe Destinations will usually ask you if you have a food allergy. We will do our best to avoid this problem while on the trip, however, we are not liable or responsible for any allergic reaction you may have on the trip. It is at the traveler’s responsibility  to bring their own medication (allergy medicine, headache medicine, EpiPen, etc.) and MEDICAL DOCUMENTS, such as health insurance and COVID testing results if required in the host country for eligible travel. D Luxe Destinations owner, director, and employees are not liable for any injury, loss, sickness, or death while on the trip and cannot be sued for such circumstances

COVID-19 Requirements

D Luxe Destinations requires all clients to comply with any COVID-19-related requirements imposed by the host country, including but not limited to vaccination, testing, and quarantine requirements. D Luxe Destinations is not responsible for any client’s failure to comply with these requirements or any consequences that may result from non-compliance. D Luxe Destinations will do our best to avoid risks during the trip, however, we are not liable or responsible  for any unforeseen circumstance concerning COVID-19 or any other incidents. D Luxe Destinations will state in the respective trip package and email you if we require you to take a COVID-19 test prior to trip start date. This is a mandatory action in order to keep you and those around you safe throughout the trip. D Luxe Destinations will not force nor require our travelers  to take the vaccine in order to travel with us. It is the travelers responsible for conducting all research in regard to requirements before travel. If you test positive for COVID-19 or become ill during or after the trip, D Luxe Destinations is not liable nor responsible for any related funds, medical expenses, other damages or losses resulting from a client’s participation in a trip.

D Luxe Destinations is not Responsible for COVID-19

D Luxe Destinations is not responsible for any COVID-19-related illness or other damages or losses resulting from a client’s participation in a trip.

As of June 12th, 2022 the CDC no longer requires COVID testing in order to travel to the United States.  However, if the traveler chooses to be tested for COVID-19 prior to entering the United States it is the traveler’s responsibility to find a medical center in the host country. The traveler is liable and  responsible for all expenses related to but not limited to  testing, transportation, accommodations, and any out-of-pocket expenses incurred in this case. 

Assumption of Risk

Clients acknowledge that travel involves inherent risks, including but not limited to risks associated with transportation, activities, and accommodations, and assume all risks associated with participating in a trip with D Luxe Destinations. While an accident can occur, medical resources or hospitals might be limited and/or not available, D Luxe Destinations is not liable for any circumstances occurring on the trip, whether while participating in activities, excursions, while at the property, or any other location. It is the travelers responsibility to obtain travel insurance and the right flight to the exact destination given to you on the trip packages. D Luxe Destinations owner, director, and employees are not liable for any injury, loss, sickness, or death while on the trip and cannot be sued for such circumstances

Travel Documents

Clients are responsible for obtaining and maintaining all necessary travel documents, including but not limited to passports, visas, and travel insurance. D Luxe Destinations is not responsible for any loss, damage, injury, or expense resulting from failure to obtain or maintain necessary travel documents.

Trip Transfer

If a client is unable to attend a trip as planned, D Luxe Destinations may permit the transfer of the reservation to another individual, subject to approval by D Luxe Destinations. The transferring client is responsible for any fees or expenses associated with the transfer.

Eligibility for 21 Years of Age

All clients must be 21 years of age or older to book and participate in a trip with D Luxe Destinations unless otherwise stated in the itinerary.

Voluntary Participation

All clients acknowledge that participation in a trip with D Luxe Destinations is voluntary and that they are responsible for their own safety and well-being during the trip. Clients 

also acknowledge that they have read and understand any risks associated with the trip itinerary and agree to assume those risks.

Capacity

D Luxe Destinations reserves the right to refuse service or to cancel a trip for any client who is deemed to be disruptive or who poses a risk to the safety or well-being of other clients or staff. D Luxe Destinations also reserves the right to limit the number of clients on a trip in order to ensure a safe and enjoyable experience for all participants. If a trip is at capacity there may be a waitlist option. If so, adding your name will give you the option of booking  if a spot may be available to you before the departure date. D luxe Destinations has the right to turn off sign-ups and advertisements at any time the package is sold out when full. If a trip does not reach a minimum capacity, the trip may be canceled or postponed and is subject to follow the same cancellation and refund policies list in policy #4. In these cases D Luxe Destinations is not responsible for any additional expenses incurred as a result of a cancellation, but not limited to non-refundable flights or other travel arrangements.

Emergency Contact

Clients must provide D Luxe Destinations with the name and contact information of an emergency contact who is not traveling with them on the trip.

Privacy Policy

D Luxe Destinations is committed to protecting the privacy of our clients. Please refer to our privacy policy for more information.

Privacy of Trip Itinerary

D Luxe Destinations does not disclose the itinerary or other details of a trip to anyone other than the clients who have booked the trip, except in cases where disclosure is required by law. You must not share private group details or personal information outside of our site as it is a violation of privacy. Your personal information, including login details, will remain confidential

Private Trip Consulting

D Luxe Destinations offers exclusive Private Trip Consulting services for clients who want to plan their dream vacation. Our Private Trip Consulting services offer a personalized and tailored approach to travel planning, where our team of experienced travel experts will work with you to craft an itinerary that meets your specific needs and preferences. These services are available for review in the service section and are  subject to additional terms and conditions that will be provided at the time of booking. D Luxe Destinations offers trip consultation services only for international destinations. Inquiries for domestic travel will decline and a refund in this case. To book any of these services, you must be a minimum age of 18 years old. The delivery time for these services can vary  based on the number of inquiries being processed.  Once the customized consulting service is completed, you will receive an email or customized document  detailing the trip package you’ve purchased. All private trips consulting services must be booked and payment received  no less than 45 days prior to your trip departure date. D Luxe destinations has reserves the right to decline service fulfillment and issue a refund  if requested is less than 45 days before your trip departure date. D Luxe Destinations travel referral credit can be used toward these services. Take note that D Luxe Destinations may be unavailable and unable to provide Private Trip Consulting services during the months of December and January. If you’re interested in traveling please book services before December or after January. If  you are not satisfied with our  Private Trip Consulting services, you may request a refund within 24 hours of booking. It is important that the content and details shared within the document cannot be copied, shared, or reproduced by or to another individual or third-party without the prior consent of D Luxe Destinations. D Luxe Destinations reserves the right to not mention the name of accommodation, transportation services and excursion and tour suppliers used,  as long as the information describing the accommodations is not misleading. We take your privacy seriously, and all information shared during our consultation process will be kept strictly confidential.

Air Flight

D Luxe Destinations is not responsible for any flights or other transportation arranged by clients outside of the trip itinerary. It is the travelers responsibility to obtain travel insurance and the correct  flight to the exact destination given in the trip packages.

Use of Images, Videos Waiver

Clients acknowledge that D Luxe Destinations may use images or videos taken during or prior to the trip for marketing, promotional purposes, business’ website, and/or all social media platforms. Clients whether solo, couple, groups and/or  private trips agree to waive any claims to permission and compensation for the use of their likeness in such materials. 

Dispute Resolution

Any disputes arising from these terms and conditions or the trip itself shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Termination

D Luxe Destinations reserves the right to terminate a client’s participation in a trip for any reason, including but not limited to non-compliance with these terms and conditions, disruptive behavior, or posing a risk to the safety or well-being of other clients or staff. In such cases, clients will not be entitled to a refund of any payments made.

Modifications and Interruptions

D Luxe Destinations reserves the right to modify or interrupt any trip, service or content of the service at any time, without prior notice. We will make every effort to provide you with suitable alternatives in such circumstances. D Luxe Destinations reserve the right to modify or discontinue all or part of the site without notice at any time.D Luxe Destinations is not liable to you or any third party for any modification, price change, suspension, or discontinuance of the services offered. D Luxe Destinations does not guarantee availability or interruption of the site.

Governing Law

These terms and conditions and the trip itself shall be governed by the laws of the state of Delaware.

Severability

If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These terms and conditions constitute the entire agreement between the client and D Luxe Destinations and supersede all prior communication, understanding, negotiations, representations, and agreements, whether written or oral, relating to the services provided. 

LIMITATIONS OF LIABILITY

D Luxe Destinations shall not be liable for any damages, losses, or expenses arising from any aspect of your trip or services we provide, including but not limited to, injuries, accidents, delays, cancellations, or any other events beyond our control.

D Luxe Destinations shall not be liable for any damages, losses, or expenses arising from the acts or omissions of any third party, including but not limited to, airlines, hotels, ground transportation providers, or other service providers.

D Luxe Destinations shall not be liable for any damages, losses, or expenses arising from any medical or health-related condition you may have during the trip, including but not limited to, illnesses, injuries, or other medical emergencies.

D Luxe Destinations shall not be liable for any damages, losses, or expenses arising from any delay, cancellation, or other interruption to your trip due to natural disasters, acts of terrorism, or other events beyond our control.

In no event shall D Luxe Destinations be liable for any indirect, incidental, special, or consequential damages arising from or related to our services, including but not limited to, loss of profits, loss of revenue, or loss of data.

You agree to release and hold harmless D Luxe Destinations, its directors, officers, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, and expenses arising from or related to your use of our services.

Indemnification

You agree to indemnify and hold D Luxe Destinations including our subsidiaries, affiliates, and all of our respective directors, and employees, harmless from and against any and all claims, damages, losses, liabilities, and expenses arising from or related to your use of our services.

Transactions, Electronic Communications and Signatures

You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You also agree to receive text messages, calls, invoices, transactions electronically, make payments respectively online, and any electronic signature that you provide to us is legally binding and enforceable. D Luxe Destinations reserves the right to contact you via all phone numbers provided to us including, business phone number to reach you concerning any upcoming payments, reminders, and any other form of communication that must be sent to you. It is your responsibility to acknowledge those messages and take the appropriate actions needed. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.

Corrections

D Luxe Destinations reserves the right to correct any errors or inaccuracies in our website or other promotional materials, even if it has already been confirmed with you. 

Disclaimer

D Luxe Destinations is not liable for any damages, losses, or expenses arising from any aspect of your trip or services we provide, including but not limited to, injuries, accidents, delays, cancellations, or any other events beyond our control.

Governing Law

These terms and conditions and any dispute arising from or related to your use of our services shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any principles of conflicts of law.

Any legal action or proceeding arising from or related to these terms and conditions or your use of our services shall be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to the personal jurisdiction and venue of such courts.

If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These terms and conditions constitute the entire agreement between you and D Luxe Destinations regarding the use of our services and supersede all prior agreements and understandings, whether written or oral
